Susan Tillotson Bunch

Susan Tillotson Bunch is the founder of Promotions and Privacy Law LLC (P Squared Law). Susan’s practice focuses on advertising, marketing, promotions, and data privacy and security, especially in emerging technologies. Susan works with clients of all sizes and types and in all marketing media. She assists clients with navigating state and federal regulatory issues implicated by content, platforms, or audience, as well as structuring compliant campaigns and promotions (such as chance, skill, user-generated content, charitable), including eSports, sweepstakes, contests, incentives, trade promotions, instant win games, commercial co-ventures, charitable raffles and more.

Susan collaborates with clients from concept to completion to ensure regulatory compliance without sacrificing marketing goals. She advises clients on program concept and structure, which typically involves preparing rules and disclosures, counseling on data, addressing prizing and fulfillment issues, complying with state registration and reporting requirements, and drafting ancillary agreements (co-sponsors, prize suppliers, celebrity endorsers, fulfillment entities, etc.).

Susan enjoys brainstorming with clients to develop creative solutions to otherwise onerous regulations. She has developed a logic-based intake portal to reduce client time and expense, as well as expedite processing of time-sensitive materials.

Susan also focuses on data privacy and security, including information management, privacy and security, and risk assessment and mitigation. She helps clients identify risks and develop proportionate strategies for threat prevention, investigation, response, notification, and remediation. Arming clients with layers of tools, policies and best practices increases brand and reputation protection in a fluid regulatory environment.

Where data privacy and marketing converge (the “GUI center”?), Susan advises clients on fluid regulatory issues, such as GDPR, CCPA, as well as other federal and state privacy and consumer protection laws. She helps enthusiastic adopters of cutting-edge technology (such as augmented reality, GPS-enabled, psychographic, multichannel, cross-platform, and geographically dispersed marketing) to navigate newly (if at all) chartered legal territory.

Passionate about all things relating to technology and cybersecurity, Susan holds the ABA’s Privacy Law Specialist certification and the ANSI-accredited IAPP-administered designations of CIPP/US, CIPM, CIPP/e and CIPT. Her experience includes litigating disputes under federal and state computer crime laws.

To pay it forward, Susan finds ways to give voice to our most vulnerable, including children and abuse or neglect victims. She has served as a guardian ad litem, a board member of A Gift for Teaching, Child Abuse Council, and Big Brothers Big Sisters, and a DV intake legal services volunteer. Susan currently volunteers at the James A. Haley Veterans Hospital.

Kent (her “indisputably better half”) and Susan have wrangled three kids and currently have two spoiled Aussie pups. In her “spare” time, Susan is the lead instructor for Tampa Bay Shotokan, which she co-founded with a group of other devoted martial artists, performs with the Fanfare Concert Winds, and geeks out over all things tech or linguistic.
